Acceptance of Terms

By accessing or using zebby.org services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

Eligibility

You must be at least 16 years old to use the Services. By using the Services, you represent and warrant that you meet this age requirement.

Account Registration

Account Creation

• Accounts are created using passwordless WebAuthn authentication
• You may choose a username and optional display name
• You are responsible for maintaining the security of your authentication credentials

Username Policy

• Usernames must be unique
• Usernames may be changed once per 24-hour period
• Usernames must not impersonate others or violate intellectual property rights
• We reserve the right to reclaim usernames that violate these Terms

Account Security

• You are responsible for all activities under your account
• Notify us immediately of any unauthorized access
• We are not liable for losses due to unauthorized use of your account

Acceptable Use

You agree NOT to:

• Use the Services for any illegal purpose
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to any part of the Services
• Interfere with or disrupt the Services or servers
• Upload viruses, malware, or malicious code
• Scrape, data mine, or systematically collect data without permission
• Impersonate any person or entity
• Use the Services for spam or unsolicited communications

Content and Conduct

User-Generated Content

• You retain ownership of content you create
• You grant us a license to store and display your content as necessary to provide the Services
• You are solely responsible for your content

Prohibited Content

Content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable is prohibited.

Service Availability

• Services are provided "as is" without warranties
• We do not guarantee uninterrupted or error-free service
• We may modify, suspend, or discontinue Services at any time
• We may perform maintenance that temporarily disrupts service

Data and Privacy

• Your use of the Services is also governed by our Privacy Policy
• You acknowledge that we may use analytics and tracking
• You may delete your account and data at any time

Intellectual Property

• The Services and all content, features, and functionality are owned by Consulting by Jeff Day
• Our trademarks and trade dress may not be used without written permission
• You may not copy, modify, or reverse engineer any part of the Services

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER

Indemnification

You agree to indemnify and hold harmless Consulting by Jeff Day from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party

Termination

• You may terminate your account at any time by deleting it
• We may terminate or suspend your access for violations of these Terms
• Upon termination, your right to use the Services ceases immediately
• Termination does not limit any other remedies we may have

Dispute Resolution

• These Terms are governed by the laws of the State of Oregon, United States
• Any disputes shall be resolved in the courts of Oregon
• You waive any right to a jury trial
• You agree to resolve disputes on an individual basis, not as a class action

Changes to Terms

• We may modify these Terms at any time
• Changes will be posted with an updated "Last Updated" date
• Continued use after changes constitutes acceptance
• Material changes may be communicated through the Services

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Consulting by Jeff Day regarding the Services.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
